Today, a federal appeals court decided to uphold California's statewide ban on the production and sale of foie gras, the French delicacy of fattened duck or goose liver. The ban went into effect on July 1, 2012.

The plaintiffs - the Association des Eleveurs de Canards et d’Oies du Quebec (a Canadian association of duck and geese farmers), California-based Hot's Restaurant Group and New York's Hudson Valley Foie Gras - asserted the ban interfered with interstate commerce and was too vaguely worded.

Judge Harry Pregerson wrote the opinion for the 9th U.S. Circuit Court of Appeals, saying: "Plaintiffs give us no reason to doubt that the State believed that the sales ban in California may discourage the consumption of products produced by force feeding birds and prevent complicity in a practice that it deemed cruel to animals."

    Good freakin grief! Like Andrew says-if it looks good, eat it. No different than raising a hog specifically for bacon. God I love bacon. I've actually never had foie gras, but it's one of those tastes like good caviar that I really want to try.

    I'm delighted the Ban on Foie Gras has been upheld well done. It is inhumane and disgusting. Now the work really starts, we must end how we abuse other species for our own selfish gain. We as human animals have a choice to eat meat, non human animals do not have a choice. To cage, torture, cause suffering and force feed and then murder other species is wrong, wrong, wrong. How would we like to be treated, certainly not in this way. Non human animals deserve a right to life. They deserve to live as they should without human intervention. We are the largest sickest predator on this planet. Please go vegan.

      It is not any more inhumane than not letting ducks sleep in beds, piss in toilets, and watch football. What *sounds* inhumane to a human, is actually not a problem for an animal with a different physiology. The ducks actually love it.

      I agree, if we kept a human in a cage and force fed him/her till they where sick and there belly and liver was fit to bursting there would be an outcry from human rights activists and we would go to jail.. We should not let animals we eat suffer throughout there lives before they end up on our plates. If we eat meat we should never buy intensively farmed animals and never buy if the Animal has not had the best quality of life, If we eat it we should respect it.. And let them die with dignity and without fear. I also think that abattoirs should have a restriction on the number of Animals that are taken in for slaughter on a daily basis. They have far too many at one time and are on a time scale to get them through, whereby a lot of them are not stunned properly and when they are hoisted up to be bled they can start to regain consciousness which is awful. So one thing we can do it write to the government and abattoirs and insist they restrict the numbers of cattle etc. entering any slaughter house at any one time so the animal does not feel stressed or frightened.

    The vitriol on this comments page is not enlightening, it's as disgusting as the people who enjoy eating tortured animals, and not to be out done by the lovely souls that torture the animals every 8 hours. Here's an interesting tidbit. Animals under stress are doused with adrenaline and other stress related hormones that you end up eating. Maybe this explains the inbred cruelty of those who think only of their palate and not of the suffering of the animals they eat. It seems it takes a long time for some people to wake up and understand that they are what they eat.

      A fetus growing inside a woman and the decision to terminate under extenuating circumstances is not the same as taking another living being to whom you have no connection, force feeding that being for your own culinary likes and then slaughtering it. Killing an animal for food is one thing and prolonged torturing it in the process is a completely different and despicable thing.

      If someone wants to take a duck which has, on its own choosing, fattened its liver up for the migration, then so be it. Can these lovers of foie gras imagine being force fed even once?

    After reading about how animals raised for food are treated, I've come to the conclusion that we humans don't deserve to ever be put in charge of any animal's life. We're just not responsible enough. We seem to think that it's our right to have anything we want, just because we want it. It never seems to occur to us to do without something-we feel so entitled. We act as though our pleasure is the only thing in the world that counts.

    I have had vegetarian "foie gras" and it is quite delicious. Once paired with some nice gourmet crackers and a nice white wine, one does not wish for poor birds' livers after having been forcibly fed.

    I love the pretentious @##$@ on here. They love themselves, oh they talk about foie gras, and wine, meanwhile last time I checked they still get sick and still have to run to the bathroom like everyone else and when your time is up its up no matter how much money you have or how much foie gras you ate :) The circle of life is such an equalizer it should be humbling but somehow people forget they can't outrun a tsunami no matter how special they think they are. LOL get over yourselves'. I'd like to take you and force a large tube down your throat and force fee you for a few weeks in a box.

      Geese and ducks raised for foie gras aren't raised in boxes. You're projecting what's done with chickens.

      And forcing a tube down a human throat is entirely different from doing the same to a duck or goose. Humans have a gag reflex that makes such a thing extremely unpleasant. Geese and ducks don't. The birds don't shy away when their feeder approaches, even after repeated tube feedings. In fact, they jostle each other, shoving their way toward the front, just as they do when fed normally.

      Get a grip on reality.

Fortunately, popular resistance forced the Coastal Commission to back off. Sadly, now that the "animal rights" community has succeeded in buffaloing the Legislature into banning pâté de foie gras, will veal be far behind? What about beef? If they have their way, we'll all be reduced to nut cutlets, and, if such views are carried to their logical conclusion, to self-starvation.

    A similar ban on horsemeat was attempted in Ontario, Canada a while back. It was met with howls of outrage, and the ban was overturned.

    To celebrate, a Toronto restaurant crafted a special dinner plate, consisting of horse tenderloin served alongside foie gras.

    They dubbed it "The Quack and Track".

    Doesn't matter. The law contains enough loopholes to allow import from elsewhere – hardly a problem, since little foie gras is produced in California, anyway.

    At worst, Californians pining for luscious foie gras can simply drive to Las Vegas – or other neighboring states – and have their fill of it.

      Foie Gras is very good. Way better than any other liver (calf / cow or chicken liver is not so good... actually gross). But foie gras is wonderful! Very rich. Served over a poached pear with a fine white burgundy... hard to top. As for the animals... face it, it is no fun to be a meal. It sucks to be a duck or a goose... no fun to be a cow or a pig or a lamb... or a pheasant... or a fish... . No fun to be a human and eaten by a lion or Shark... but in all cases it is the circle of life. We are all food for the worms some day... so enjoy everything you eat.... the worms will not mind that you ate a fattened goose liver.

    This just mades me sick. Imagine doing something like that to humans. I stopped eating beef and pork four years ago on the advice of my vegetarian oncologist (doctor). He told me that science is moving closer to admitting that the wonder drugs that we are feeding to the animals to fatten them up is causing the cancers we are seeing. Chicken is next on my prohibition list, but I don't want to give up eating fish. Does anyone have any ideas on this?

    Does it seem strange to anyone that people will fight through the highest courts for proper animal treatment but remain hushed on child abusers and molesters? An animal is food. Humans are the ones that have domesticated them, turned them into pets and who require all this correct treatment. WHile we have people starving within our borders. Animals are treated so because we are a nation of gluttons and we want our food, but want to shut the farms down. The rate the country is going, the movie 'Soylent Green" may become actuality. Put your hard efforts behind the rights of humans not the food sources.

    Whether these birds have food stuffed down their mouths or they eat willingly is not the issue. It is the fact that we know, or should know that it is wrong to torture or manipulate and not respect things that give their lives to sustain us.

    I'd even venture to say that we should also find it immoral to kill another specie's youth for food.

    I just know if humans were a food source I wouldn't want us to be treated the way we treat anything that we eat.

We eat animals, it isn't going away. If you are a vegaterian, so be it, that is your call, I eat meat, I hunt it, shoot it, skin it and store and eat it. Its who I am, I have no friendswho are vegaterian, but most vegayarians are not my type of people, that Iis people whowish to control what others do because of their conscience, my conscience is clean.

        but the big difference is that the humans treat the animals like pets ,they control their life ,keep them in captivity and after eta them ,the animals kills the animals in nature ,hunt them and eat them ,the humans eat meat,but they ask to others people to kill them ,if we really had to kill ourselves the animals we eat ,i am sure most of the people will stop to eat meat .When an animal kill an other animal in the wild , they have a chance to escape ,they can fight for their survival ,and the weaker will lose ,how animals are kill in slaughterhouses for example ,gives no chance to the animals ,a cowardly way to kill them

    Have you ever visited a duck farm? I have visited several in Southwest France and watched the ducks being "force"fed. You would think that if they didn't like being fed they'd run away from the farmer but they don't – they hang around quite happily. This is just one more ridiculous ban engineered by a loudmouthed minority.

        Uh – lots of migratory fowl store fat in their livers naturally. It's how they manage to migrate, remaining in flight for days or weeks at a time without stopping for food. In production, they're feed grain. Their bodies turn it into fat, which is preferentially stored in the liver. No nastiness involved.

    I'm glad the court upheld this ban. I'm also against eating Veal. The kill and slaughter process can be brutal and inhumane. Adding to the animals' misery for "better taste" is just wrong. And if you're wondering, I do eat meat.

    To James: For what it's worth – and I hold no affinity for Halal restrictions – that method of slaughter is far more humane than what is most commonly practiced. Cutting the neck and allowing the animal to bleed out may be graphic but it is less painful than the beating, abuse, and live carving much of the beef in the USA enjoys during slaughter. Again, it may be messy and it makes for easy sensationalist commentary, but bleeding out an animal is a humane way to kill it. Also, it is healthier to eat animals that have been slaughtered in this manner. I believe Kosher eating requires the same.

      Producers will continue to provide feed and fresh water to animals, clean their barns daily, and harvest the livers, as well as the remaining edible meat, feet, & visera that they always do. Peaople eat duck. people eat, period. I have visited these types of farms, as well as others throughout the United States...Farmers do care about their animals, their products and peoples rights to choose their own diets. God bless the farmers who feed us many different diets and flavors.

        An electric shock fed directly to the brain kills the cow or pig or sheep in less than 5 seconds. Animal knows nothing and feels pain for a fraction of a second. I believe this is EU standard on humanely killing an animal at the slaughter house. Did you even youtube the halal way of killing an animal by "torture"?

        Well, it's kind of hard not to feel superior when humans do rule over animals. The reality is, we have a lot of people on this planet who need to eat. If you got a problem with how the animals are raised or killed that are our food sources, then create laws that limit how many children you can have. Stop allowing so many people to procreate and therefore add to the burden of feeding them. We have kids that go hungry every single minute in this world as well as adults too. How bout spending your time worrying about people that dont get to eat, period- then animals that are destined for consumption

      You have to like liverwurst to like foie gras. It tastes like liverwurst with a hint of horseradish. Personally, I like it, but it's pricey. If you want to try it, whip some liverwurst with a little horseradish and seasonings. Practically the same thing.

        I'm not at all convinced it's cruel. It LOOKS cruel to us, because humans have a gag reflex strong enough that even the sight of a similar operation on another animal can trigger it. But ducks and geese don't have such a reflex to begin with. You won't see these animals fleeing in terror at the approach of their feeder, even after repeated encounters. In fact, they crowd around, just as they do when fed any other way, jostling for their turn.

          No, because that won't happen with humans. Again, humans aren't geese or ducks. Their biology is radically different. For geese, accumulating fat in the liver is absolutely normal, not "necrotic"; it's an adaptation to long-distance migration that lets them store enough fuel to fly for days, even weeks, without stopping for food.

      It's really, really good.

      It's tricky to prepare properly, though; unless you know what you're doing, you probably shouldn't attempt it yourself. It's one of the few food items you're much better off having professionally prepared – unless you can afford to apprentice with someone to teach you on their dime.

      Definitely worth a try if you have a chance.

      It's nothing like liverwurst. That poster has obviously never had it.

        I second that. It is really delicious however I have had my share of botched foie before. I hate when chefs do some fancy molecular gastronomy thing with foie. Just a simple pan sear, with stewed fruit of some sort would do.

        My favorite preparation of all time was at LaCroix in Philadelphia about 5 years ago. Seared foie gras, cherry mostrada, bacon-shortbread croutons served with monbazillac.

        Another awesome animal product: veal sweetbreads. Preferably seared with a nice crispy crust.

        Agree with the professional prep. Foie gras is ~$50 per pound. If you figure in the time and cost to procure foie gras, and the necessary accoutrements, and the effort to prepare it....best to let someone else do it.

      its pretty tasty. Its got a buttery taste to it when placed on bread, but not a sickening oil feel as if you had stuck a chunk of butter in your mouth.

      its kind of like a tasty buttery spread on some bread.

      pricey tho and not really worth it imo..rather get lobster dipped in butter, which incidentally is at its cheapest nowadays.
